Our client was undergoing treatment for early-onset dementia when hospital staff mistakenly injected MRI contrast material into an external ventricular drain, a procedure that had no medical purpose or justification. Secured the full $1 million commercial policy limits on behalf of three siblings who were injured when the vehicle in which they were passengers was rear-ended by a commercial vehicle on an upstate New York highway. Despite minimal property damage and the defense's contention that the low-impact collision could not have caused the claimed injuries, the case was developed through extensive medical evidence demonstrating the aggravation of pre-existing conditions, new soft tissue injuries, more than a year of conservative treatment, and arthroscopic surgical procedures for two of the three plaintiffs. Following aggressive litigation and mediation, the insurer tendered its entire $1 million policy limits before the court ruled on the parties' pending summary judgment motions.

Although the driver carried only a $100,000 individual automobile policy, deposition testimony revealed evidence that he may have been operating the vehicle in a commercial capacity at the time of the accident. Rather than accept the $100,000 policy tender, we continued pursuing the defendant personally based on evidence of potential assets and commercial activity. After the case was placed on the trial calendar, we ultimately secured a $425,000 settlement prior to trial.

Bar Negligence / Facial Laceration

Our client, a woman in her mid-40s, was patronizing a bar when a bartender became confrontational and began threatening her over her interaction with another patron. During the confrontation, the bartender aggressively swung a glass bottle near our client’s face. The bottle broke and caused a laceration near her jawline that required stitches and resulted in residual scarring. The defendant moved to dismiss, arguing that the case was an intentional assault claim barred by the one-year statute of limitations and that there was insufficient evidence beyond our client’s testimony. We successfully opposed the motion by establishing that the bartender’s conduct supported a negligence theory subject to a three-year statute of limitations and that our client’s testimony created issues of fact for a jury. After defeating the defendant’s attempt to dismiss the case, we proceeded to mediation and secured a $275,000 settlement for our client. The result was particularly significant given the evidentiary challenges in the case and the relatively limited physical injury, which consisted primarily of the facial laceration and residual scarring.

Our client’s decedent was a South Korean national who had overstayed a student visa and was killed in a motor vehicle accident. She had no known next of kin in the United States and left behind virtually no records or supporting documentation beyond the autopsy report. We undertook extensive Surrogate’s Court proceedings to establish an estate and secure the appointment of a Public Administrator, while also coordinating with the South Korean Embassy to address the unique issues presented by the decedent’s immigration status and lack of family representation. Despite these significant procedural and evidentiary hurdles, we successfully secured a $100,000 tender of the full available insurance policy on the wrongful death claim.
